2021 Recodification of Town Code - Title 16

The Town of Kittery has retained a land use and zoning consultant, North Star Planning, to lead a process resulting in the preparation of a new Land Use and Development Code.

The Town of Kittery has amended its land use code (Title 16) frequently over the years to keep pace with development and changing Town objectives. In light of new development pressures and the unintended consequences of years of separate amendments, the Town desires to rewrite the land use code to be more consistent in interpretation and application, equitable and defensible, unified with the Town’s Updated Comprehensive Plan, and compatible with required state and federal laws. 

February 2022 Update:

On January 24, 2022, the Kittery Town Council unanimously adopted the proposed recodification of Title 16 Land Use & Development Code. The updated Title 16 Land Use & Development Code will be in force beginning February 24, 2022. The updated code may be viewed or downloaded here. In the coming months, the updated code will be uploaded into the Town's online code library here.

December 2021 Update:

On November 18, 2021, the Planning Board closed their Public Hearing and voted to recommend the draft Title 16 code to Town Council for review. Town Council voted on December 13, 2021 to hold a Public Hearing at the January 24, 2021 Town Council meeting. Town Council will also hold a Workshop with the Planning Board on Monday, January 3, 2021 at 6pm.

October 2021 Update:

The Planning Board held a Public Hearing at their Thursday, September 23rd meeting and voted to continue the Public Hearing at the October 14 meeting. A memo outlining the changes to the zoning code may be read here.

September 2021 Update:

The Planning Board will hold a Public Hearing on the recodification of Title 16 on Thursday, September 23 at 6pm. The latest draft of the zoning code may be reviewed here.

The Planning Board meeting will be held virtually via Zoom. To access the meeting, click here

The Planning Board may close the Public Hearing and recommend the draft code be adopted by Town Council, or recommend it not be adopted, or the Board may continue the Public Hearing to a subsequent meeting.
